LIMITATIONS AND EXCLUSIONS OF THE
OMAHA PUBLIC POWER DISTRICT PRODUCTS & SERVICES
(“OPPD PRODUCTS & SERVICES”)
IN-HOME ELECTRICAL PROTECTION PLAN (“PROTECTION PLAN”) PROVIDED BY
UTILITY SERVICE PARTNERS PRIVATE LABEL, INC. (“USP”)
FOR SINGLE FAMILY HOMES

1) The Omaha Public Power District has contracted with Utility Service Partners Private Label, Inc. (USP) to offer this Protection Plan for single family homes under the name “OPPD Products & Services”. By enrolling in the Protection Plan, you agree to the terms set forth herein. This Protection Plan is not a contract of insurance. This Protection Plan covers repair or replacement of customer-owned components of the “electrical lines” in the residence (single family dwelling) that fail from normal wear and tear. “Electrical lines” include wiring, switches, outlets, receptacles, boxes, fuses, breakers, or connectors, extending from the service entrance wiring at the weather head or meter socket through the receptacle or fixture box. If your home is situated on a slab, your in-home electrical line(s) may be embedded in concrete which may require rerouting your electrical lines as a means of repairing or replacing your electrical lines. Reasonable efforts will be made to avoid cutting through the slab, walls and ceilings. The decision whether to repair or to replace a covered in-home electrical line is within the discretion of USP. Coverage is limited to $1,500 per occurrence with no annual or lifetime cap.

2) In order for a claim under this Protection Plan to be valid, you must call OPPD PRODUCTS & SERVICES at 1-866-277-3706 before any repair work is performed. All written communication concerning the Protection Plan shall be directed to OPPD PRODUCTS & SERVICES, c/o USP, 11 Grandview Circle, Suite 100 Canonsburg, PA 15317. All repair work must be performed by an authorized OPPD PRODUCTS & SERVICES contractor. No payments will be made for work performed by a non-OPPD PRODUCTS & SERVICES contractor.

3) OPPD PRODUCTS & SERVICES retains the right to inspect your electrical lines for damage after you enroll, or at the time of a claim, and you agree to permit OPPD PRODUCTS & SERVICES contractors to come into your home to conduct such inspections or to repair or replace your electrical service lines under the Protection Plan. The contractor must have safe access to, and safe working conditions at and around, the work area.

4) Coverage under the Protection Plan starts 30 days after enrollment and continues thereafter so long as you make timely payments. Coverage may be canceled for nonpayment. Your account must be in good standing (current) to receive service under the Protection Plan. OPPD PRODUCTS & SERVICES may modify this Protection Plan by giving you 30 days’ written notice. If OPPD PRODUCTS & SERVICES cancels the program for reasons other than nonpayment, you will be reimbursed the pro rata share of any amount you paid for any portion of the Protection Plan period subject to cancellation.

5) You have 30 days from the date you enroll in the Protection Plan to cancel and receive a full refund of any payments you have made. Thereafter, you may cancel your participation in the Protection Plan at any time, and you will be reimbursed the pro rata share of any amount you paid for any portion of the Protection Plan period subject to cancellation; provided, however, OPPD PRODUCTS & SERVICES is not obligated to refund sums less than $6.00.

6) The Protection Plan does not cover in-home electrical lines that you knew, or that a reasonable person should have known, were in need of repair or damaged before you enrolled in the Protection Plan. In addition, the Protection Plan does not cover:

  • materials that are defective; that is, failed for reasons other than normal wear and tear;
  • the cost of repairing, replacing, or moving a meter(s) that is not being relocated as a means of repairing or replacing your electrical lines;
  • electrical lines not installed according to applicable building or safety codes, ordinances or industry standards;
  • fixtures, appliances, appliance cords, extension cords, light bulbs, or radiant floor heating elements, outside pool heaters, water heater elements;
  • knob and tube wiring;
  • landscape lighting, exterior lighting, or any other wiring leaving the primary dwelling;
  • electrical lines serving secondary buildings not attached to the home (e.g. detached garages and storage sheds);
  • updating and/or moving components of the electrical system to meet code, ordinance, or other legal requirements;
  • removal of obstacles to access the electrical lines;
  • damage to an electrical line that is caused, directly or indirectly, by you, third parties, natural disasters, acts of God, claims covered by homeowners insurance, or other insurable causes;
  • service lines owned by the utility or connected to any commercial facility, condominium, multi-family, or manufactured home (also known as a mobile home ). If you own a condominium, or multi-family unit home, please call 1-866-277-3706 for further enrollment information.

7) After electrical lines are replaced or repaired, OPPD PRODUCTS & SERVICES will provide general cleanup. The Protection Plan does not cover restoration of the areas affected by the repair (e.g. such as restoring concrete, dry wall, paint, plaster or wallpaper, etc.). If slab cutting is necessary, the resulting trench will be patched. The Protection Plan does not cover restoration of the affected areas (e.g., floor covering including carpet, hard wood, marble, ceramic tile, dry wall, paint, plaster or wallpaper etc.).

8) By enrolling, you represent that the electric lines are free from any pre-existing problems or malfunctions.

9) OMAHA PUBLIC POWER DISTRICT AND USP DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE. IN NO EVENT SHALL OPPD OR USP BE LIABLE FOR ANY CLAIMS OR DAMAGES BEYOND THE REPAIR OR REPLACEMENT OF COVERED ELECTRIC LINES SET FORTH HEREIN AND NEITHER OPPD NOR USP SHALL BE LIABLE UNDER ANY THEORY OF LAW FOR ANY PUNITIVE, EXEMPLARY, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND.
